Terms of Service
The plain-English rules for using Mini Brains Play.
These terms are an agreement between you and Mini Brains Play, operated by Tina Benias (ABN 76 657 946 691) (“we”, “us”). By creating an account or using our app or website, you agree to these terms. If you don’t agree, please don’t use the service.
1. What we provide
Mini Brains Play gives you a simple daily, screen-free play activity to do with your child, along with progress tracking, a Journey and other features. The activities are ideas for play, offered for general educational and entertainment purposes. You know your child best — please use your own judgement, supervise your child at all times, and keep play safe and age-appropriate.
2. Your account
You must be at least 18 and an adult parent or carer to create an account. You’re responsible for keeping your login secure and for activity under your account. Please give accurate information and keep it up to date. You can delete your account at any time from inside the app (Settings → Delete my account).
3. Subscriptions and payments
Some features require a paid subscription. Prices are shown in the app or on our website before you buy.
- On the App Store, subscriptions are billed through your Apple account. They renew automatically each period unless you turn off auto-renew at least 24 hours before the end of the current period. You manage or cancel in your Apple account settings; Apple’s terms and refund policies apply.
- On the web, subscriptions are billed through Stripe and renew automatically until you cancel from your account or by contacting us.
- Founding pricing, where offered, stays at the founding rate for as long as your subscription remains active and unbroken.
Except where required by the Australian Consumer Law or the relevant app store, payments are non-refundable for partial periods. Cancelling stops future renewals; you keep access until the end of the period you’ve paid for.
4. Acceptable use
Please use Mini Brains Play for your own family’s personal, non-commercial use. Don’t copy, resell or redistribute our content, try to break or misuse the service, or use it in any unlawful way.
5. Our content
All activities, text, illustrations, branding and other materials in Mini Brains Play are owned by us or our licensors and are protected by copyright. We grant you a personal, non-transferable licence to use them within the app for your family. Anything you add (like your moments) stays yours; you grant us permission to store and display it back to you as part of running the service.
6. No professional advice
Our content is general in nature and is not medical, developmental, psychological or professional advice. If you have concerns about your child’s development or health, please speak with a qualified professional.
7. Availability
We work hard to keep the service running well, but we can’t promise it will always be available, uninterrupted or error-free. We may update, change or discontinue features over time.
8. Our responsibility to you
Nothing in these terms excludes rights you have under the Australian Consumer Law, including guarantees that cannot be excluded. Subject to those rights, to the extent permitted by law we are not liable for indirect or consequential loss, and our total liability to you is limited to the amount you paid us in the 12 months before the claim.
9. Ending the agreement
You can stop using the service and delete your account at any time. We may suspend or close an account that breaches these terms or the law.
10. Changes to these terms
We may update these terms from time to time. If we make significant changes, we’ll let you know in the app or by email. Continuing to use the service after changes take effect means you accept the updated terms.
11. Governing law
These terms are governed by the laws of South Australia and the Commonwealth of Australia, and you agree to the exclusive jurisdiction of the courts there.
